ADVERTISERS TERMS AND CONDITIONS

Gîtes Direct agrees to act as letting agent for the property owners (The Member). The Property is offered for rental by Gîtes Direct to the renter ("The Client) under the following conditions.
1. The Terms and Conditions set out below govern all bookings made by Gîtes Direct
and apply to "Deposit only" Members as well as those taking our "Complete Booking
Service". Our fees are 15% of the total rental cost for the former and 26% of
the total rental cost for the later. These charges may be liable to change, but
not without prior notice.
2. Gîtes Direct undertakes to design and build the advertising material for the rental property and display it on their website Free of Charge for life or until we are notified in writing to remove it. Although a proof copy of the advertisement will be given to the Member or an electronic link provided to it, Gîtes Direct reserves the right to change or modify the advertisement without prior notice to the Member. Advertisements or amendments, will be displayed on the Internet within 5 working days of an agreed proof being received at our offices The copyright of all advertising material designed by Gîtes Direct on behalf of its advertisers is strictly the property of Gîtes Direct and may not be used by any third party without our express permission.
3. Gîtes Direct will prosecute to the full letter of the law any Client who reneges
on a booking once a deposit has been received and the booking is confirmed. Prices
cannot be changed for any reason once a booking is confirmed and a deposit is
paid. Should it be proved that a client initiated from our website has booked
Directly with a Member. Gîtes Direct will invoice the Member for our 15% fee.
4. The 25% deposit is non refundable. In the event that the booking is cancelled after full payment has been made and there is good cause to refund the full rental price a "Deposit Only Member" agrees to refund the full amount under the clauses provided in their own Terms and Conditions notice. In the event of a cancellation being made after the full amount has been paid, Gîtes Direct will refund to the Client on behalf of its Complete Booking Service Members the following amount. 6 to 8 weeks before arrival 85% of the balance less 5% administration fee, Les than 4 -6 weeks before arrival 50% of the balance less 5% administration fee. No refunds will be made if cancellation is made less than 4 weeks before arrival. 10% of the final balance will be deducted as our fee and the remainder paid to the Member.
5. Gîtes Direct is part of the France Direct Holiday Cottage Owners Group. As associate members of the France Direct Holiday Cottage Owners Group, you agree to abide by the Terms and Conditions of the group and any other third party, whom we have chosen to advertise with and whose brochure(s) or Internet sites the group agrees to be included in.
6. Gîtes Direct does not under any circumstances undertake to organise or arrange "Change Over Cleaning", Cleaning or Maintaining of Client's Swimming Pools, nor taking or return payments as "Breakage Deposits". This must be organised by the Client or the Client's representatives. We will notify the client if a Breakage deposit is required and inform them that it must be paid on arrival. Gîtes Direct will not become Directly involved in any disputes arising from the failure to reimburse such deposits, but may be called upon as an independent arbiter if necessary. The property must at all times be clean and tidy and in a fit condition to receive our Clients.
7. Gîtes Direct is registered under the European Data Protection Act. As such all information provided to us is strictly confidential and only the Advertising Details will be made publicly available. Personal details will not be made available to any third parties without your express permission.
8. Advertisers agree to inform Gîtes Direct at their earliest convenience of changes to their availability. Gîtes Direct accepts no responsibility for any loss of revenue which may result from the lack of such notification. Advertisers may be liable under the EEU Trade Descriptions Act, should they make any false statements or misrepresentation. Advertisers may also be liable under the EEU Consumer Protection Act 1987, if they do not ensure that the prices advertised are a true reflection of prices charged.
9. Gîtes Direct cannot be held responsible for any errors or omissions in any advertisement. Gîtes Direct undertakes to accurately reproduce all advertisements submitted, but cannot be held responsible for any loss or damaged incurred as a result of errors or omissions. Gîtes Direct reserves the right to refuse any advertisement and will not be held responsible for any expenses or losses incurred. Gîtes Direct undertakes to safeguard all material supplied to us. Gîtes Direct will remove any advertisement within 48 hours of receipt of a written request from the advertiser.
10. Gîtes Direct cannot accept liability in any circumstances where performance of the contract is prevented by reason of: War or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disasters, fire, flood or adverse weather conditions, acts of God, closure of ports or airports, epidemics, government action, failure to meet transport timetables or any similar events outside our control.
